The recent attack on Supreme Court Chief Justice Gavai is an abominable and cowardly act, stated Mohammad Asad, an educationist and renowned legal expert.
He described the incident in the nation’s apex judicial system as an unfortunate occurrence that deeply harms the spirit of our democracy. Mr. Asad opined that the state of affairs, having arrived at this point decades after independence, suggests the implementation of a policy aimed at weakening the judiciary and influencing the judgements of judges.
While such incidents are often contained in the Supreme Court and High Courts due to adequate security, the lack of a similar security system to prevent such occurrences in District and Mandal level courts is alarming.
Mohammad Asad stated that the decline in respect, values, and reverence for courts, judges, judgements, and other systems began in the country after 2014. He expressed distress that similar developments are now taking place even in states ruled by the Bharatiya Janata Party (BJP), following the party assuming power at the Centre.
He further noted that the increased autocratic and dictatorial tendencies are reflected in the continued use of bulldozers in Uttar Pradesh, even after the Supreme Court repeatedly stated that the use of bulldozers is contrary to the Constitution under Article 14.
In this context, Mr. Asad stressed the crucial need to analyze the Babri Masjid judgement. He said that by observing the recent successive interviews given by former CJI Chandrachud after his retirement, everyone can understand this issue. He argued that the judgement makes it clear that the Supreme Court and its judges are being influenced by political pressures and ideological affinities. He also pointed out a similar political angle behind the verdicts favoring Adani in several cases related to his financial transactions.
Mr. Asad criticized the Supreme Court’s verdict on the Waqf Amendment Act bill, stating that it failed to address or correct the concerns of the petitioners regarding the intent and idea behind the bill. Although the Supreme Court granted a stay on certain matters, it conspicuously left crucial issues untouched.
Finally, he concluded that the attack on the Chief Justice of India serves as an example of the historical contempt held by the upper castes towards the marginalized and weaker sections, which is not a phenomenon of the last decade alone. He expressed concern that society has been tacitly approving and welcoming such actions for the past ten years. Recalling the protests and criticisms over the failure to invite President Murmu to the inauguration of the new Parliament building, Mr. Asad pointed out that the incident was a clear testament to the discrimination shown towards her social community, a fact which caused anguish to many at the time.
